1. PURPOSE OF THIS DISCLAIMER

The Leonyx Hypoxic Wellness Studio/Pod (“Product”) is a controlled-environment training system that exposes users to reduced-oxygen environments, heat, cooling, photobiomodulation (PBM), and variable physical exertion.

This Safety & Medical Disclaimer (“Disclaimer”) outlines the health considerations, usage restrictions, and risk assumptions associated with the Product.

By signing this Disclaimer, the Customer and all users acknowledge they fully understand the physiological stresses involved and agree to operate the Product responsibly and within safe limits.

2. NOT A MEDICAL DEVICE

The Product:

Is NOT a medical device
Is NOT intended for diagnosis, prevention, treatment, or cure of any disease
Is designed exclusively for wellness, recovery, performance, fitness, and recreational use
Cannot replace medical advice or therapy
Must not be used as a substitute for professional health care

No claims are made regarding medical outcomes.

3. MANDATORY MEDICAL CLEARANCE (WHEN REQUIRED)

Users must seek medical clearance from a qualified healthcare professional if they have or suspect any of the following conditions:

3.1 Respiratory Conditions

Asthma
Chronic obstructive pulmonary disease (COPD)
Pulmonary hypertension
Sleep apnea
Respiratory disorders requiring medication

3.2 Cardiovascular Conditions

Hypertension (uncontrolled high blood pressure)
History of heart attack
Heart murmur or arrhythmia
Cardiac surgery
Stroke history
Poor circulation

3.3 Neurological Conditions

Epilepsy
Blackout or fainting history
Seizure disorders
Migraines triggered by light

3.4 Pregnancy

Pregnant individuals must NOT use hypoxia modes.
Mild IR or PBM may be permissible only with explicit medical clearance.

3.5 Other Medical Conditions

Diabetes
Anemia
Kidney disease
Autoimmune disorders
Metal implants sensitive to heat
Recent surgery
Severe obesity
Claustrophobia

If unsure, the user must consult a doctor before using the Product.

4. AGE RESTRICTIONS

To ensure user safety:

Children under 14 must NOT use hypoxia modes under any circumstances
Anyone under 18 must be fully supervised by a responsible adult
Only adults who have completed the Leonyx induction may operate environmental controls

5. USER RESPONSIBILITY

All users must:

Follow all safety instructions in the Leonyx App
Complete the mandatory induction video
Limit session duration to recommended guidelines
Gradually progress environmental intensity
Stop immediately if symptoms arise
Keep the Product clean and free from hazards
Ensure adequate ventilation around generator/compressor
Ensure correct electrical supply and grounding

The Customer accepts full responsibility for anyone they allow to use the Product.

6. HYPOXIA SAFETY WARNINGS

The Product simulates altitudes of ≈ 3,000 (10,000 ft) – 5,500m (18,000 ft).
Hypoxia affects individuals differently.

6.1 Symptoms of Hypoxia

Users may experience:

Light-headedness
Shortness of breath
Tingling
Blurred vision
Cognitive slowing
Reduced coordination

If symptoms worsen:

→ STOP USE IMMEDIATELY
→ Seek medical evaluation if symptoms persist

6.2 Conditions When Hypoxia Must Not Be Used

Users must NOT use hypoxia features if:

Pregnant
Under 14
Have serious cardiac or pulmonary conditions
On sedatives, alcohol, or recreational drugs
Feeling unwell or dehydrated

7. HEAT (IR) / COOLING SAFETY WARNINGS

The Product may include:

Infrared sauna elements
Cooling modules
Photobiomodulation panels

7.1 Heat Exposure

Avoid IR heat if:

Pregnant
Diabetic with neuropathy
Have cardiovascular disease
Have heat intolerance
Recent skin grafts or implants

7.2 Cooling Exposure

Avoid cold exposure if:

Have Raynaud syndrome
Poor circulation
Nerve damage
Heart conditions

8. PHOTOBIOMODULATION (PBM) SAFETY

PBM affects cellular behavior. Users must:

Avoid staring directly into PBM LEDs
Avoid use if sensitive to flicker
Avoid use if epileptic (unless cleared medically)

9. EXERTION & COGNITIVE LOAD WARNINGS

The Product may be used with:

Ergometers
Stepr units
Cognitive reaction tasks
Breath control training

Users must:

Begin progressively
Avoid maximal effort unless medically cleared
Avoid complex tasks if feeling lightheaded
Stop if judgment or coordination feels impaired

10. SITE & ENVIRONMENTAL SAFETY

Customer must ensure:

The Product is placed on a stable, level surface
Room has proper ventilation
Generator & compressor have required clearance
Electrical supply meets minimum requirements
No flammable materials are near heat elements
Children do not control environmental settings

11. CUSTOMER AGREES TO HOLD LEONYX HARMLESS

The Customer:

Assumes all risk of use
Accepts liability for incorrect, excessive, or unsafe operation
Releases Leonyx from liability for misuse or non-compliance
Acknowledges that physiological response varies widely among individuals

12. LIMITATION OF LIABILITY

Leonyx is not responsible for:

Injury, harm, or fatality due to misuse
Use without medical clearance when recommended
Use by unsupervised minors
Operation outside recommended guidelines
Customer modifications
Environmental hazards in the installation site

To the full extent permitted by law:

Leonyx’s maximum liability is limited to the amount paid for the Product.

13. GOVERNING LAW & ARBITRATION

This Disclaimer is governed by the laws of:

Queensland, Australia

Any dispute relating to safety or use of the Product will be resolved exclusively by binding arbitration in Queensland.

14. ACKNOWLEDGEMENT

By signing this form, the Customer confirms:

They have read, understood, and accepted all safety risks
They understand the Product is not a medical device
They acknowledge medical clearance may be required
They assume responsibility for safe operation
They understand misuse may result in injury or death
They accept all terms without exception
